CarsComm Terms & Conditions

for using our services across Australia.

These Terms and Conditions (Terms) govern your access to and use of the CarsComm website, mobile application, platform, services, products, features and related technology.

The platform is operated by CarsComm Pty Ltd ABN 70 610 633 522 (CarsComm, we, us or our).

By creating an account, accessing or using CarsComm, clicking “I agree”, downloading the CarsComm app, browsing our website or using any CarsComm feature, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use CarsComm.

1. About CarsComm

CarsComm is a digital platform designed to help vehicle owners, drivers and vehicle-related businesses communicate, collaborate and manage vehicle-related information.

CarsComm may allow users to:

  • create and manage vehicle profiles;

  • store vehicle registration, insurance, service and other vehicle-related documents;

  • communicate with other users through 2-way messaging;

  • record accident, damage or incident information through Prang Log;

  • report, receive or assist with Missing Vehicle alerts;

  • nominate a Next of Kin or emergency contact;

  • manage care, service and maintenance information;

  • connect with mechanics, tyre shops, auto service providers and other vehicle-related businesses;

  • access other vehicle, safety, communication, community and support features made available through CarsComm.

CarsComm is a platform provider only. Unless we expressly state otherwise, CarsComm does not provide mechanical services, repair services, towing services, emergency services, insurance services, roadside assistance, medical services, law enforcement services or legal advice.

2. Acceptance of these Terms

You accept these Terms when you:

  • create an account;

  • click “I agree” or a similar acceptance button;

  • download, install or use the CarsComm app;

  • access or use the CarsComm website;

  • use any CarsComm service or feature;

  • continue using CarsComm after being notified of updated Terms.

Your use of CarsComm may also be subject to additional policies, guidelines or feature-specific terms, including our:

  • Privacy Policy;

  • Community Guidelines & Code of Conduct;

  • Child Safety & Harm Prevention Policy;

  • Partner or Provider Terms, if applicable;

  • any additional terms displayed in the app or website.

If there is an inconsistency between these Terms and any feature-specific terms, the feature-specific terms will apply to the extent of the inconsistency.

3. Eligibility and Age Requirement

CarsComm is intended solely for individuals who are 18 years of age or older.

By creating an account, accessing or using CarsComm, you represent and warrant that:

  • you are at least 18 years old;

  • you have the legal capacity to enter into a binding agreement;

  • all information you provide to CarsComm is accurate, complete and current;

  • your use of CarsComm complies with all applicable laws and regulations.

Individuals under 18 years of age are not permitted to create an account, access or use CarsComm.

If CarsComm becomes aware that an account has been created or used by a person under 18 years of age, CarsComm may suspend or terminate the account immediately and delete associated information where appropriate and permitted by law.

4. Account Registration

To access certain CarsComm features, you may need to create an account.

When creating or maintaining an account, you must provide accurate, complete and current information, which may include:

  • your name;

  • email address;

  • mobile number;

  • username;

  • password;

  • vehicle registration number;

  • vehicle details;

  • address or location details;

  • emergency contact details;

  • other information reasonably required to provide CarsComm services.

You are responsible for keeping your account information accurate and up to date.

CarsComm may refuse to create an account, suspend an account or terminate an account if we reasonably believe that:

  • information provided is false, inaccurate, misleading or incomplete;

  • you are not eligible to use CarsComm;

  • your account is being used in breach of these Terms;

  • your use may create legal, safety, security, privacy or reputational risk for CarsComm or other users.

5. Account Security

You are responsible for:

  • maintaining the confidentiality of your login details;

  • all activity that occurs under your account;

  • ensuring that no unauthorised person accesses your account;

  • immediately notifying CarsComm if you suspect unauthorised access or a security breach.

You must not:

  • share your account with another person;

  • allow another person to use your login details;

  • impersonate another person;

  • create an account using false information;

  • access another user’s account without permission.

CarsComm is not responsible for loss or damage caused by your failure to keep your account secure.

6. Vehicle Profiles and Vehicle Information

CarsComm may allow you to create and manage vehicle profiles.

You are responsible for ensuring that all vehicle information you provide is accurate, lawful and current.

Vehicle information may include:

  • registration number;

  • make, model, year, colour and body type;

  • state or territory of registration;

  • vehicle nickname;

  • images;

  • insurance information;

  • registration information;

  • service records;

  • maintenance history;

  • ownership, caretaker or authorised user details;

  • notes or other information you choose to add.

You must not add a vehicle to CarsComm unless you are authorised to do so.

CarsComm may remove, restrict or suspend access to vehicle profiles if we reasonably believe that:

  • the vehicle information is inaccurate, misleading or unlawful;

  • the vehicle profile infringes another person’s rights;

  • the vehicle is being used in connection with misuse, fraud, harassment or unlawful conduct;

  • removal is necessary to protect CarsComm, users or the public.

7. Glovebox and Document Storage

CarsComm may allow you to upload and store documents through Glovebox or similar features.

Documents may include:

  • registration papers;

  • insurance documents;

  • service records;

  • receipts;

  • warranty records;

  • roadside assistance documents;

  • repair records;

  • vehicle images;

  • other vehicle-related information.

You are solely responsible for the documents you upload.

You warrant that:

  • you have the right to upload and store the documents;

  • the documents are accurate and lawful;

  • the documents do not infringe another person’s rights;

  • you will not upload malicious, unlawful, misleading or inappropriate material.

CarsComm is not responsible for verifying the accuracy, completeness, legality or usefulness of documents uploaded by users.

CarsComm may remove or restrict access to uploaded documents where reasonably necessary to protect users, comply with law, enforce these Terms or protect CarsComm’s systems and reputation.

8. 2-Way Messaging and User Communications

CarsComm may allow users to send and receive messages through the platform.

You are responsible for all messages and communications sent from your account.

You must not use CarsComm messaging to:

  • harass, abuse, threaten, intimidate or stalk another person;

  • send false, misleading, offensive or unlawful messages;

  • impersonate another person;

  • send spam or unsolicited commercial messages;

  • send discriminatory, defamatory or harmful content;

  • request or disclose information unlawfully;

  • interfere with another person’s privacy;

  • promote scams, fraud or unlawful activity;

  • send malware, malicious links or harmful content.

CarsComm may monitor, review, moderate, restrict, remove or disclose messages where reasonably necessary to:

  • operate the platform;

  • investigate misuse;

  • respond to support requests;

  • protect users;

  • comply with law;

  • enforce these Terms;

  • prevent fraud, harassment, spam or unlawful conduct.

CarsComm does not guarantee that messages will be delivered, read, acted upon or responded to within any particular timeframe.

9. Prang Log, Accident, and Incident Records

CarsComm may provide Prang Log or similar features that allow users to record accident, damage or incident-related information.

Prang Log may allow users to record:

  • date and time of an incident;

  • location information;

  • damage descriptions;

  • photos or videos;

  • third-party details;

  • insurance information;

  • police or claim reference numbers;

  • notes or statements;

  • other incident-related information.

You are responsible for ensuring that any information you enter into Prang Log is accurate, lawful and appropriate.

CarsComm does not verify Prang Log information and does not guarantee that it will be accepted by insurers, police, courts, repairers or any other third party.

Prang Log is provided for record-keeping convenience only. It is not legal advice, insurance advice, claims management advice or a substitute for obtaining professional assistance.

You should contact emergency services, police, your insurer, roadside assistance, legal advisers or other relevant professionals where appropriate.

10. Missing Vehicle Feature

CarsComm may provide Missing Vehicle or related features that allow users to report, receive, share or respond to information about a vehicle that may be missing, moved, towed, damaged, unattended or otherwise of concern.

You must use Missing Vehicle features responsibly and lawfully.

You must not:

  • make false or misleading reports;

  • accuse another person without proper basis;

  • encourage confrontation or unsafe conduct;

  • trespass, pursue, threaten or interfere with another person;

  • disclose personal information unlawfully;

  • use the feature for harassment, surveillance or vigilante behaviour.

CarsComm does not guarantee the recovery, location, identification or condition of any vehicle.

CarsComm is not a law enforcement agency, towing locator service, roadside assistance provider or emergency response service.

If you believe a vehicle is stolen, involved in a crime or connected to an emergency, you should contact the relevant authorities immediately.

11. Next of Kin and Emergency Contact Features

CarsComm may allow you to nominate a Next of Kin or emergency contact.

By adding an emergency contact, you warrant that:

  • the information is accurate and current;

  • you have obtained the person’s consent or have lawful authority to provide their information;

  • the person understands that they may be contacted through or in connection with CarsComm features;

  • you will update or delete the information if it becomes inaccurate or consent is withdrawn.

CarsComm may use emergency contact information to facilitate safety-related notifications or communications through the platform.

CarsComm does not guarantee that:

  • an emergency contact will be notified;

  • a message will be delivered, read or acted upon;

  • emergency assistance will be provided;

  • another user will take appropriate action;

  • any safety outcome will be achieved.

CarsComm is not an emergency service. In an emergency, you must call 000 or contact the relevant emergency, medical, police, roadside assistance or other authority.

12. Care Centre, Service Provider, and Partner Features

CarsComm may allow users to connect with mechanics, tyre shops, auto service providers, towing providers, roadside assistance providers, insurers, repairers or other third-party businesses.

Unless expressly stated otherwise:

  • third-party providers are independent businesses;

  • CarsComm does not employ, control or supervise third-party providers;

  • CarsComm is not responsible for their acts, omissions, pricing, advice, workmanship, availability, quality, safety or service outcomes;

  • CarsComm is not a party to any contract between you and a third-party provider;

  • any dispute with a provider must be resolved directly with that provider.

CarsComm may display provider listings, contact details, promotions, advertisements, service categories, ratings or other information. Such information may be supplied by the provider or third parties.

CarsComm does not guarantee that provider information is accurate, complete, current or suitable for your needs.

You are responsible for making your own assessment before engaging any third-party provider.

13. Payments, Subscriptions, and Paid Features

CarsComm may offer free and paid features.

If paid features, subscriptions, bookings, listings or partner services are made available, applicable fees, billing terms and renewal terms will be displayed before purchase or sign-up.

You agree to pay all applicable fees associated with your selected services.

Unless otherwise stated:

  • fees are in Australian dollars;

  • fees include GST where applicable;

  • subscriptions may renew automatically if you agree to automatic renewal;

  • you are responsible for maintaining valid payment details;

  • failed payments may result in suspension or cancellation of paid features.

CarsComm may use third-party payment processors. Payment processing may be subject to the processor’s own terms and privacy policy.

CarsComm does not store full credit card details unless expressly stated.

14. Refunds and Cancellations

Your rights to refunds, cancellations and remedies are subject to the Australian Consumer Law and any rights that cannot lawfully be excluded.

Where CarsComm supplies paid digital services directly to you, refund rights will depend on:

  • the nature of the service;

  • whether there has been a failure to comply with applicable consumer guarantees;

  • the seriousness of any failure;

  • the terms displayed at the time of purchase;

  • applicable law.

Unless required by law, CarsComm is not required to provide a refund because:

  • you changed your mind;

  • you no longer need the service;

  • you failed to use the service;

  • you entered incorrect information;

  • a third-party provider did not meet your expectations;

  • you breached these Terms.

If your refund request relates to a third-party provider’s services, you must contact that provider directly, unless CarsComm expressly processed the relevant payment as merchant of record.

CarsComm may, at its discretion, assist with communication between users and providers but is not obliged to resolve third-party disputes.

15. Acceptable Use

You must use CarsComm lawfully, responsibly and respectfully.

You must not:

  • breach any law or regulation;

  • infringe another person’s rights;

  • misuse personal information obtained through CarsComm;

  • upload false, misleading, defamatory or unlawful content;

  • use CarsComm for harassment, abuse, stalking, threats or intimidation;

  • send spam or unauthorised marketing;

  • scrape, harvest, mine or collect user data;

  • reverse engineer, copy or modify the platform;

  • interfere with the operation, security or performance of CarsComm;

  • introduce viruses, malware or harmful code;

  • bypass security or access controls;

  • create fake accounts;

  • impersonate another person or business;

  • use CarsComm to facilitate fraud, crime or unsafe conduct;

  • use CarsComm in a way that damages our reputation or goodwill.

CarsComm may investigate suspected breaches and take action including warnings, content removal, feature restriction, account suspension, account termination or referral to relevant authorities.

15A. Child Safety & Harm Prevention Policy

CarsComm is an adult-only platform intended solely for users aged 18 years and older.

All users must comply with the CarsComm Child Safety & Harm Prevention Policy, as updated from time to time.

CarsComm maintains a zero-tolerance approach to any content, conduct, communication or activity that harms, exploits, endangers or places a person under 18 years of age at risk.

Without limiting any other rights available to CarsComm, we may immediately:

  • remove content;

  • restrict platform features;

  • suspend accounts;

  • terminate accounts;

  • preserve relevant records;

  • report matters to law enforcement agencies, regulators, app stores or other appropriate authorities; and

  • take any other action reasonably necessary to protect users, the platform or the public.

The Child Safety & Harm Prevention Policy forms part of these Terms and Conditions.

16. User Content

You retain ownership of content you upload, submit, send, store or make available through CarsComm, including vehicle information, documents, images, messages, accident notes, comments and other materials (User Content).

By providing User Content to CarsComm, you grant CarsComm a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, store, reproduce, process, display, transmit, modify, adapt and disclose User Content for the purpose of:

  • operating CarsComm;

  • providing features and services;

  • enabling user communications;

  • storing and displaying vehicle information;

  • supporting safety, incident and emergency-contact features;

  • improving, securing and maintaining the platform;

  • complying with law;

  • enforcing these Terms.

You warrant that:

  • you own or have permission to provide User Content;

  • User Content is accurate where accuracy is relevant;

  • User Content does not infringe another person’s rights;

  • User Content does not breach any law;

  • User Content does not contain viruses or harmful code.

CarsComm may remove, restrict, preserve or disclose User Content where reasonably necessary to operate the service, protect users, comply with law or enforce these Terms.

17. Intellectual Property

CarsComm owns or licenses all intellectual property rights in the CarsComm platform, website, app, software, design, interface, branding, logos, icons, databases, content, systems, source code, object code, trade marks, business names and related materials.

You are granted a limited, personal, non-exclusive, non-transferable, revocable licence to access and use CarsComm for your own lawful personal or authorised business use, strictly in accordance with these Terms.

You must not, without CarsComm’s prior written consent:

  • copy, reproduce, modify, adapt or distribute CarsComm materials;

  • reverse engineer, decompile or disassemble the platform;

  • create derivative works based on CarsComm;

  • remove copyright, trade mark or proprietary notices;

  • use CarsComm branding without permission;

  • use CarsComm data to build a competing product;

  • scrape, crawl or copy platform content;

  • commercially exploit CarsComm except as expressly permitted.

All rights not expressly granted are reserved by CarsComm.

18. Privacy

CarsComm handles personal information in accordance with its Privacy Policy.

By using CarsComm, you agree that CarsComm may collect, use, hold and disclose personal information as described in the Privacy Policy.

You must not provide personal information about another person unless you have their consent or lawful authority to do so.

This is especially important for:

  • emergency contacts;

  • Next of Kin information;

  • accident or incident reports;

  • third-party vehicle details;

  • insurance or registration documents;

  • messages;

  • uploaded images or documents.

19. Marketing and Communications

CarsComm may send you service, account, safety, legal, security and administrative communications.

CarsComm may also send marketing communications where permitted by law, including updates about features, promotions, partner offers, events or services.

Where required, CarsComm will obtain consent before sending marketing communications.

You may unsubscribe from marketing communications by:

  • using the unsubscribe link in emails;

  • replying STOP to SMS messages, where available;

  • changing app preferences;

  • contacting CarsComm.

You may still receive non-marketing communications, including safety, legal, account, transactional and service-related messages.

20. Third-party Websites, Apps, and Services

CarsComm may contain links, integrations or references to third-party websites, apps, services, advertisers, providers or platforms.

CarsComm is not responsible for:

  • third-party content;

  • third-party availability;

  • third-party privacy practices;

  • third-party security;

  • third-party products or services;

  • third-party advice or representations;

  • any loss arising from your use of third-party services.

Your use of third-party services is at your own risk and may be subject to separate terms and privacy policies.

21. Platform Availability and Changes

CarsComm may modify, update, suspend, discontinue or remove any part of the platform at any time.

CarsComm does not guarantee that:

  • the platform will always be available;

  • the platform will be uninterrupted or error-free;

  • defects will be corrected immediately;

  • all features will remain available;

  • all data will be available at all times;

  • the platform will be compatible with all devices, systems or networks.

CarsComm may perform maintenance, upgrades or security updates which may affect availability.

Where reasonably practicable, CarsComm may provide notice of material changes or planned outages.

22. No Emergency, Safety, or Professional Advice

CarsComm may include safety-related, incident-related, communication or emergency-contact features.

However, CarsComm is not:

  • an emergency service;

  • a police service;

  • a medical service;

  • a roadside assistance provider;

  • a towing service;

  • an insurer;

  • a mechanic;

  • a legal adviser;

  • an insurance adviser;

  • a safety monitoring service.

You must not rely on CarsComm as your only method of seeking emergency assistance, reporting crimes, managing accidents, contacting emergency contacts or protecting your safety.

In an emergency, call 000 or contact the relevant authority.

CarsComm does not guarantee that alerts, messages, reports or emergency-contact notifications will be delivered, received, read, acted upon or successful.

23. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or protection under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Subject to those non-excludable rights, CarsComm excludes all warranties, guarantees, representations and conditions not expressly stated in these Terms.

Where CarsComm is permitted to limit liability for breach of a non-excludable guarantee, CarsComm’s liability is limited, at CarsComm’s option, to:

  • resupplying the relevant services;

  • paying the cost of resupplying the relevant services.

24. Disclaimers

To the maximum extent permitted by law, CarsComm provides the platform on an “as is” and “as available” basis.

CarsComm does not warrant or represent that:

  • the platform will meet your requirements;

  • the platform will be uninterrupted, secure or error-free;

  • any information provided through the platform is accurate, complete or current;

  • any message, alert or notification will be delivered or read;

  • any vehicle will be located, repaired, protected or recovered;

  • any emergency contact will respond;

  • any third-party provider will perform services properly;

  • any uploaded document will be available, accepted or legally effective;

  • any incident record will be accepted by insurers, police, courts or other third parties.

You use CarsComm at your own risk.

25. Limitation of Liability

To the maximum extent permitted by law, CarsComm is not liable for any loss, damage, cost, expense or claim arising from or in connection with:

  • your use of or inability to use CarsComm;

  • inaccurate, incomplete or outdated user information;

  • User Content;

  • messages sent or received through CarsComm;

  • misuse of the platform by users;

  • third-party provider conduct;

  • vehicle accidents, damage, theft, loss or recovery;

  • emergency-contact features;

  • Prang Log records;

  • Missing Vehicle reports;

  • uploaded documents;

  • unauthorised access caused by your failure to secure your account;

  • service interruptions, errors, delays or outages;

  • loss of data;

  • viruses, malware or harmful code;

  • third-party websites, apps or services.

To the maximum extent permitted by law, CarsComm will not be liable for indirect, consequential, special, exemplary or punitive loss or damage, including loss of profits, revenue, business, goodwill, opportunity, data or reputation.

Where liability cannot be excluded, CarsComm’s total aggregate liability to you is limited to the greater of:

  • the amount paid by you to CarsComm in the 12 months before the event giving rise to liability; or

  • AUD $100.

This limitation does not exclude liability that cannot be excluded by law.

26. Indemnity

You agree to indemnify CarsComm, its directors, officers, employees, contractors, agents, related bodies corporate, partners and licensors against any loss, damage, liability, claim, cost or expense, including reasonable legal costs, arising from or connected with:

  • your breach of these Terms;

  • your misuse of CarsComm;

  • your User Content;

  • information you provide about another person;

  • your infringement of another person’s rights;

  • your unlawful conduct;

  • your interactions with other users;

  • your dealings with third-party providers;

  • your failure to obtain consent for emergency contact or third-party information;

  • any claim made against CarsComm because of your conduct.

This indemnity is reduced to the extent that the loss was caused by CarsComm’s fraud, wilful misconduct or negligence.

27. Suspension and Termination

CarsComm may suspend, restrict or terminate your account or access to CarsComm if we reasonably believe that:

  • you breached these Terms;

  • you are under 18;

  • you provided false or misleading information;

  • your conduct creates legal, privacy, security, safety or reputational risk;

  • you misuse messaging or safety features;

  • you infringe another person’s rights;

  • you use CarsComm unlawfully;

  • suspension is necessary to protect CarsComm, users or the public;

  • CarsComm is required or permitted to do so by law.

You may stop using CarsComm at any time.

You may request account deletion by contacting CarsComm or using available account settings.

On termination:

  • your right to use CarsComm ends immediately;

  • CarsComm may disable your access;

  • CarsComm may delete or de-identify information where appropriate;

  • CarsComm may retain information where required or permitted by law;

  • clauses intended to survive termination will continue.

28. Data Retention after Termination

After your account is closed, CarsComm may retain information where reasonably necessary to:

  • comply with legal obligations;

  • resolve disputes;

  • enforce these Terms;

  • prevent fraud or misuse;

  • maintain security;

  • keep business, tax, audit or accounting records;

  • respond to law enforcement or regulatory requests;

  • manage insurance, legal or compliance matters.

CarsComm will handle retained personal information in accordance with its Privacy Policy.

29. Complaints and Reporting Misuse

If you believe another user has misused CarsComm, breached these Terms or acted unlawfully, you may report the matter to CarsComm.

CarsComm may investigate reports at its discretion.

CarsComm is not obliged to:

  • investigate every report;

  • remove every item of content;

  • suspend every reported user;

  • disclose investigation outcomes;

  • mediate every user dispute.

Where appropriate, CarsComm may refer serious matters to law enforcement or relevant authorities.

30. Disputes between Users

CarsComm is not responsible for disputes between users.

This includes disputes about:

  • messages;

  • vehicle information;

  • accident records;

  • missing vehicle alerts;

  • emergency contact notifications;

  • uploaded content;

  • third-party provider services;

  • payments made to third parties;

  • offline interactions.

CarsComm may, at its discretion, assist with communication or investigation, but is not required to resolve user disputes.

31. Dispute Resolution with CarsComm

If a dispute arises between you and CarsComm, you agree to first contact CarsComm and attempt to resolve the dispute in good faith.

A party claiming that a dispute has arisen must give written notice to the other party setting out:

  • the nature of the dispute;

  • relevant details;

  • the outcome sought;

  • any proposed resolution.

The parties must attempt to resolve the dispute within 14 days after notice is given.

If the dispute is not resolved within 14 days, either party may refer the dispute to mediation in New South Wales, Australia, unless urgent court relief is required.

Each party must bear its own costs of mediation unless otherwise agreed.

This clause does not prevent either party from seeking urgent interlocutory or injunctive relief.

32. Change to these Terms

CarsComm may update these Terms from time to time.

If CarsComm makes material changes, we may notify you by:

  • posting updated Terms on our website;

  • providing in-app notice;

  • sending an email;

  • requiring renewed acceptance;

  • using another reasonable method.

The updated Terms will apply from the effective date stated in the updated version.

If you do not agree to updated Terms, you must stop using CarsComm.

Your continued use of CarsComm after the effective date means you accept the updated Terms.

33. Competitors and Prohibited Commercial Use

You must not access or use CarsComm for the purpose of:

  • building a competing product or service;

  • copying CarsComm’s features, data, design or functionality;

  • scraping or harvesting user information;

  • benchmarking CarsComm without permission;

  • monitoring CarsComm for competitive purposes;

  • commercially exploiting CarsComm without written consent.

If you breach this clause, CarsComm may suspend your access and seek all available legal remedies.

34. Force Majeure

CarsComm is not liable for delay or failure to perform obligations caused by events beyond its reasonable control, including:

  • internet or telecommunications failures;

  • cloud provider outages;

  • cyberattacks;

  • power failures;

  • natural disasters;

  • fire, flood, storm or extreme weather;

  • war, terrorism, civil unrest or government action;

  • labour disputes;

  • pandemics or public health emergencies;

  • changes in law;

  • third-party platform failures.

35. Assignment

You must not assign, transfer or novate your rights or obligations under these Terms without CarsComm’s prior written consent.

CarsComm may assign, transfer or novate its rights or obligations under these Terms as part of a merger, acquisition, restructure, sale of business, investment transaction or transfer of assets, provided this does not materially reduce your non-excludable legal rights.

36. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be severed to the extent necessary and the remaining provisions will continue in full force and effect.

37. No Waiver

A failure or delay by CarsComm to exercise a right under these Terms does not constitute a waiver of that right.

A waiver must be in writing and signed by CarsComm.

38. Entire Agreement

These Terms, together with the Privacy Policy and any applicable feature-specific terms, form the entire agreement between you and CarsComm regarding your use of the platform.

They replace any prior understandings, representations or agreements relating to your use of CarsComm.

39. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia.

You agree that the courts of New South Wales, Australia, and any courts entitled to hear appeals from those courts, have jurisdiction in relation to any dispute arising out of or connected with these Terms or CarsComm.
